The SAFE Act requires all state MLO license applicants to submit to a criminal background check through FBI fingerprinting as part of the NMLS application process. This check reviews for felony convictions and other disqualifying criminal history. Separately, applicants must also authorize a credit report review as part of the financial responsibility assessment, but that is a distinct requirement from the criminal background check. Civil litigation records and personal reference checks are not the mechanism used for the mandatory criminal history review.
